The Federal Court of Justice in Karlsruhe (VI ZR 233/17) has just ruled that the images of mini cameras in cars may be used as evidence in court. When in doubt, the concerns about data protection should be classified as secondary, which is exactly what we see. In principle, the BGH classifies the recordings in such a way that they violate data protection law, but since those involved in the accident have to provide information on people, insurance or the driver's license anyway, this is to be classified as subordinate.
Although the judgment does not mean that you can now automatically film permanently, the inadmissibility does not mean that the images cannot be used in civil processes. And if instead of a simple one Dashcam a so-called Crash cam with a loop function, you are largely on the safe side. Basically, it is always a question of weighing up in individual cases. Deputy Sheriffs who film every little thing and show it will have no chance! Dashcam recordings are now limited as evidence allowed and this is likely to provide even more popularity of small miniature cameras. Already 8% of 1000 surveyed motorists are driving with the miniature cameras and more 13 percent are considering doing so in the future. Next 25 percent can imagine it. Three quarters of respondents consider the recordings particularly helpful in the event of an accident.
