Customs duty for tuning! Swiss have a hard time in Germany

Germany is not only the market leader in the automotive sector but also in terms of Tuning Accessories extremely popular. Thousands of tuning freaks therefore come from abroad and have their vehicles refurbished in Germany. But especially for Swiss this is since the 1. January 2018 significantly more costly and cumbersome. If a Swiss wants to refine his car in Germany, he / she must pay a deposit of 10% of the vehicle value and 19% VAT and a lot of bureaucracy.

The local Swiss garage owners are of course happy because this almost forces potential buyers to have their conversions carried out exclusively in Switzerland. The German customs have been rigorously implementing the “inward processing” procedure since the turn of the year and there are apparently no exceptions. The background to the new rule is that you want to prevent the vehicle from being significantly upgraded in Germany (high quality alloy wheels, expensive body kits, performance upgrades, etc.) and thus increase in value and then sold without paying VAT on importation.

The sequence:

  • the driver must report to the customs what is to be done on the car and how high the costs are about. The complicated three-page form must be completed with exact vehicle type, desired accessories and the serial number and handed over to customs
  • 29% must be on the table at customs (19% sales tax and 10% customs fees of the vehicle value)
  • when entering the country, the vehicle must be presented to the customs again and this must be for Okay are located. Only then will the deposit be returned

when is there actually an "okay" and when not?

Even the installation of a trailer hitch is connected to the above-mentioned procedure and out of proportion to the effort. 10% of current vehicle value and 19% VAT in cash on a trailer hitch for 300 €? Without words! Incidentally, if you “forget” to register, the criminal consequences are safe. There's not even an allowance. The measure is actually intended to prevent vehicles from Switzerland from being sold in Germany without paying sales tax on import. About 800 companies in the border area are currently suffering from the new regulation and there is great hope that the procedure will be simplified.

An example:

  • A Swiss would like to join one BMW M2 F87 Coupe have a set of new alloy wheels installed. A beautiful forged rim including tires costs as well as installation according to the estimate already good and like 5.000 €. This refinement must be registered with the customs. And now it comes: A BMW M2 facelift LCI (2017) with DKG costs around the 64.000 €. Therefore 10% of the vehicle value in the amount of 6.400 € must be deposited and 12.160 € in the form of the 19% sales tax.

    A total price of 18.560 €.

Don't forget that it's an M2 Coupé and not a Lamborghini, Ferrari or Porsche. Upon entry, an officer checks the wheels / rims and if everything is correct, the money is returned. Kindly you can then start your journey home with just under 20.000 € in your luggage and will probably be booked in at the next routine check on suspicion of money smuggling or a similar assumption.
