There is a misconception that you only have to expect fines and driving bans if you are drunk travels by car, truck or bus. The higher regional court in Zweibrücken decided in the case Az.: 1 Owi SSbS 40/21 accordingly, on which the working group "Traffic law of the German Bar Association (DAV)' now indicates. In the case, a man was driving an electric scooter under the influence of drugs and was caught by the police. The competent district court sentenced the driver to a fine of 500 euros and a driving ban. However, the man took action against the decision. The person concerned argued that driving under the influence of drugs or alcohol on an electric scooter should not be expected to result in a driving ban on a regular basis.
E-scooters are relatively light and slow - right is that argument?
But the objection had no success before the Higher Regional Court. The driving ban was not lifted just because it was an e-scooter. When assessing the danger of drunk or drug driving, it comes will not on the lower mass and speed, but on the probability of endangering other people with the unsafe or unpredictable driving style. Despite its lower mass and manageable speed, an e-scooter has a potential to endanger or injure other people that should not be underestimated.
Alcohol and drugs increase the risk potential
Since e-scooters accelerate much faster and easier than a bicycle, the driver must be able to control the speed at all times. However, if the sense of balance is impaired, sudden movements with the handlebars have a major impact on driving style and can cause critical situations for other road users. Anyone who is under the influence of alcohol and/or drugs on an e-scooter increases this risk and must therefore expect a driving ban.
