But the objection had no success before the Higher Regional Court. The driving ban was not lifted just because it was an e-scooter. When assessing the danger of drunk or drug driving, it comes not on the lower mass and speed, but on the probability of endangering other people with the unsafe or unpredictable driving style. Despite its lower mass and manageable speed, an e-scooter has a potential to endanger or injure other people that should not be underestimated.

Alcohol and drugs increase the risk potential

Since e-scooters accelerate much faster and easier than a bicycle, the driver must be able to control the speed at all times. However, if the sense of balance is impaired, sudden movements with the handlebars have a major impact on driving style and can cause critical situations for other road users. Anyone who is under the influence of alcohol and/or drugs on an e-scooter increases this risk and must therefore expect a driving ban.
