Repairs to the car: when can goodwill be expected?

To step after expiration the legal one Warranty obligation respectively the New Vehicle Manufacturer Warranty If there are defects in a vehicle, there is still hope for them Goodwill from the manufacturer. However, this is a very complex subject that is often accompanied by a number of problems. It's probably every driver's nightmare. For two years there was no reason for complaint and the car has served its purpose. But shortly after the statutory warranty expires, major damage becomes apparent. This can be a defective turbocharger, a broken engine or a gearbox that no longer shifts. Also a defective one Air conditioning compressor is not exactly a bargain.

A big defect – now what?

Then you now have two options. Scenario 1: there is one New vehicle warranty before, which may also be a species Used Car Guarantee can act. This is offered by some manufacturers as well as by various insurance companies. The second possibility is that the car does not have any insurance against defects and defects. If the first case applies and there is a guarantee on a new car connection, then you first have to take a good look at the insurance policy. In the guarantees for the new car connection or the used car are often several Insurance Exclusions included that were not necessarily the focus of the sales pitch when the warranty was taken out.

What is the guarantee period for EU re-imports?

In the case of EU re-import vehicles such as those from Volkswagen, the warranty period begins not already on the day of the first registration by the buyer living in Germany. Instead, it only starts when the vehicle is sold by the car manufacturer and the foreign dealer will be overwritten, who will then re-import it to Germany. Consequently, the warranty period may extend a little shorten. Accordingly important can the goodwill arrangement will. If you no longer have a guarantee at all, you can only hope for goodwill from the manufacturer.

hope for goodwill

If you don't have insurance, you can only contact the manufacturer and ask about a goodwill arrangement. It means that the vehicle manufacturer decidesto pay part of the repair cost or not. This is usually the case when the vehicle is not very old and only has a few kilometers. The car owner may even be so lucky that the total cost for the material and the working hours are taken over. However, in order to even have a chance of accepting a goodwill request, all prescribed maintenance work must generally be carried out in the manufacturer's authorized workshop.

It should be clear to every car owner that legally no goodwill claim has. However, most do not know that the manufacturer can even prescribe like the repair process and the processing of the goodwill request. The problem here is that it is literally a "goodwill gesture". This means that it is a volunteers and sometimes too arbitrary performance of the manufacturer. First of all, you are always the contractual partner for the repair of the car itself and not the vehicle manufacturer. As a customer you can Cost estimate request that in its obligation largely is committed. It can also clarify the consequences if the costs cannot be met and may increase. For example, the workshop can give feedback by telephone in advance if an increase in costs is to be expected.

Despite everything, according to the law, the customer can not requirethat goodwill before implementation of the repair is assumed or guaranteed by the vehicle manufacturer. If the manufacturer does it anyway, then that is of course very positive. As already described above, this performance is pure on the part of the manufacturer voluntary. So there is no legal basis which means that the manufacturer cannot do what he wants. So if you take the car to the authorized workshop and the manufacturer refuses to cover the costs at the end of the repair, then you're out of luck. In the end, the customer only has one option, one free workshop and hope for the good fortune that the manufacturer will nevertheless offer him an accommodating cost sharing. Incidentally, it can be worth it the customer himself contact the manufacturer and arrange for prior clarification.

Of course, that wasn't the end of it.

  1. Until now, I didn't know that there were differences in the warranty period for EU re-import vehicles. I need to have the brakes on my Audi replaced. I will definitely visit a master car workshop for this in the next week.

  2. Unfortunately, I found out that my car has a defective clutch. It is therefore interesting to know that the car may still have a used car guarantee. I will find out about it and take the car to the auto repair shop.

  3. Thank you for the well described article. I didn't even know a lot of the points about car repairs myself. Now I am well prepared for my project.
