We recently received an interesting question from a reader. The reader Bernd S. asked us something about the topic Cars abroad sign in: "Can I register my vehicle with an acquaintance in Serbia and drive it in Germany? The background is structural changes that do not endanger traffic safety, but due to Changes to the exhaust system (the cat is AND REMAINS removed, and can no longer be installed) an approval / TÜV acceptance is no longer possible in this country. It doesn't matter in Serbia, the vehicle would be registered there. My friend from Serbia would also take over the insurance and let it run on him. The insurance also allows me, as the driver, to drive the vehicle "abroad" and also covers any damage in Germany/Europe. After registration (according to the registration office, the vehicle does not even have to be there), he would send me the license plates. So there's something wrong with him letting me have the vehicle so I can drive here"?

We can say that this project is legally subject to § 20 FZV (Vehicle Registration Regulation) opposite. A quote as follows:

Section 20 Temporary participation in domestic road traffic
(1) Vehicles registered in another member state of the European Union or another state party to the Agreement on the European Economic Area may temporarily be used in domestic traffic if a valid registration certificate has been issued for them by a competent authority in the other member state or in the other state party and the Inland no regular location is justified. The registration certificate must contain at least the information that is provided in the vehicle registration booklet for vehicles with a red license plate in accordance with Annex 9. Registration certificates according to sentence 1 that meet the requirements of sentence 2 and are issued exclusively for the purpose of transferring a vehicle are published by the Federal Ministry of Transport and Digital Infrastructure in the traffic bulletin. Sentence 1 does not apply to a vehicle that was located in Germany at the time of registration by the other member state or other contracting state.
(1a) Trailers that do not require registration in another Member State of the European Union or in another contracting state to the Agreement on the European Economic Area may temporarily be used in domestic traffic if they are towed by a towing vehicle that is registered in the same Member State or in the same contracting state and in Inland no regular location is justified.
(2) Vehicles registered in a third country may be used temporarily in domestic traffic if a valid registration certificate or an international registration certificate in accordance with Article 4 and Annex B of the International Agreement of April 24, 1926 on Motor Vehicle Traffic has been issued for them by a competent foreign authority and none in Germany regular location is justified. The registration certificate must contain at least the information required under Article 35 of the Convention of 8 November 1968 on Road Traffic. Sentence 1 does not apply to a vehicle that was in Germany at the time of registration by the third country.
(3) Foreign vehicles may only temporarily take part in domestic traffic if they are operational and roadworthy.
(4) If the registration certificate is not written in German and does not comply with Directive 1999/37/EC or Article 35 of the Convention of November 8, 1968 on Road Traffic, it must be accompanied by a certificate issued by a career consular officer or honorary consul of the Federal Republic of Germany in translation certified by the issuing state or linked to a translation by an internationally recognized automobile club in the issuing state or by a body designated by the Federal Ministry of Transport and Digital Infrastructure.
(5) The driver of the motor vehicle must carry the foreign registration certificate in accordance with paragraph 1 or 2 and the translation required in accordance with paragraph 4 or the international registration certificate in accordance with paragraph 2 and hand them over to the responsible persons for inspection upon request.
(6) A period of up to one year is considered temporary within the meaning of paragraphs 1 and 2. The deadline begins
1. in the case of registration certificates with the date of crossing the border and
2. in the case of international registration certificates in accordance with the International Agreement of April 24, 1926 on Motor Vehicle Traffic, with the date of issue.

But what exactly does the legal text say? He states that use in Germany is already excluded if the vehicle at the time of approval not in Serbia, but in Germany (Keyword “send number plate”). Of course you say to yourself now: "Who should remember where the vehicle was at the time of registration?" That is correct. In 99% of the cases this should be irrelevant. But there are other points that make the project impossible. Because there must not be a regular location abroad - the vehicle may only be "visiting" so to speak. This would also not be the case in this case. Furthermore, the vehicle may only “temporarily” participate in domestic road traffic. According to Section 20 (6) FZV, a period of up to one year is temporary. The idea would not be viable as a permanent solution, and the effort would be disproportionate as a short-term solution. The project is not permitted from a legal point of view and an inspection will be carried out lead to problems.
