According to the Criminal Code, such individual races are punishable if: "the road user moves at an inappropriate speed, as well as grossly contrary to traffic and recklessly, in order to achieve the highest possible speed.“ But apparently it was not applicable of the facts according to the public prosecutor's office.

It was found that it was on the said route no speed limit and the speed, according to the road traffic regulations, is therefore dependent on visibility and weather conditions as well as the personal abilities of the vehicle and driver. And according to the prosecutor, the video clearly showed that the traffic conditions were excellent.
