Through so-called Re-imports can save consumers on car purchases when they buy a new car from the dealer. But can you recognize a re-import later when reselling it? Is a private seller not forced to point out the re-import when reselling the car. However, buyers can contest the purchase request if they specifically asked the seller about it. Then the purchase application is an afterthought contestable. There is also a judgment from the regional court in Zweibrücken (Az .: 8 U 85/17). The Working Group on Traffic Law of the German Lawyers' Association (DAV) now expressly refers to this judgment.

It is legally possible. A short time later, the woman found out that your purchase was a Re-import acts. What happens at car dealers is that cars that were not initially intended for the German car market are re-imported a little later. These cars are usually cheaper for car dealers because abroad, the prices are not as high as in Germany. The Porsche convertible buyer, however, feels misled by the private seller, since she said that a re-import is not that valuable like a vehicle straight from Germany. She has canceled the sales contract and Asked for your money back. However, the seller refused. This is how the lawsuit came about.

The court provides the following reason for the judgment!

In the verdict, the court could no fraudulent misrepresentation of the woman. Due to the market behavior when buying a car, according to the court, it cannot be assumed that re-imports are inherently less valuable than car purchases in Germany. Since the woman did not expressly say in the sales pitch that she did not want to buy a re-import, she cannot ask for her money back. The purchase contract can only be challenged if the seller withholds this point upon express request.

  1. Good to know that you can save money when buying a car with a so-called re-import. I once heard something similar about BMW EU Reimport, but wasn't quite sure what it meant. That definitely sounds very attractive to me.
