Since 2004, the consumption value has to be recognizable on every new car at a motor show etc. However, there is an exception, especially with fuel swallowers. A tuned car does not have to indicate any changed consumption values. According to the Frankfurt Higher Regional Court, this would be “too expensive” for the tuners. The reason was a complaint by a manufacturer against a tuner who exhibited his vehicle at the IAA in Frankfurt.
The tuner did not provide any information on consumption either on the advertising sign or in a trade magazine. On the increased engine power, however. The manufacturer saw this as a violation and sued. According to the OLG, a tuned car is a "special case" and therefore the rule does not apply. A tuner is usually content with the cheaper but lengthy individual acceptance at TÜV or Dekra, where no official consumption data in the sense of the Pkw-EnVKV is collected.
