Today we would like to provide you with a little experience report on our own behalf some reading material and are curious how your opinion on this is. It's about a privately purchased VW Phaeton. We bought the good piece at the end of November somewhere in Hamburg, It is a Phaeton in Campanella white with a mileage of about 244.000 km. The fact that, in a former luxury class vehicle with an original price of around 100.000 € after a quarter of a million miles, of course, can expect no perfectly maintained, and technically flawless, vehicle should be self-understood.

Nevertheless, the vehicle looked surprisingly good and was presented by the car dealer with a lot of pictures and even a personal video. The reason was that a trip to Hamburg was not possible and we therefore wanted / had to find out as much as possible about the vehicle via WhatsApp and phone calls. The car dealer even offered us to deliver the vehicle for a fee, which ultimately convinced us to agree to the purchase. In the previous phone calls we were informed that the navigation system's navigation screen is defective (allegedly due to a € 300 control unit in the rear) and that the winter tires are probably not the best because they made some noises.

Otherwise, the car would be in a technically perfect condition and so it finally came to the handover at us, as well as the signing of a contract of sale not in the B2B area but to a private person because the vehicle is not used commercially. Since no guarantees and warranties were excluded in the standardized sales contract, it is a normal sales contract for a used vehicle from a dealer to private. While the handover took place in the late evening, and with some lack of time, the awakening the next day was all the worse. The vehicle could not be opened with the remote control but only by manually unlocking the driver handle.

Soon it should turn out that this is only the beginning of a clearly existing list of defects that were simply withheld from us. Reason enough to get the vehicle into the workshop and confront us with the following problems.

  • Comfort battery left defective - 250 €
  • Wheel bearing left + right side defective - 355 € (the winter tires make noises)
  • Worn rear brake - € 380
  • Keyless Go driver side defective - 450 €
  • Navi screen processor damage - 700 € (repair)
  • Front right air suspension leaking - price 880 €
  • Rain sensor defective - price unknown
  • Tailgate cable break - 800 €
  • Xenon control unit front right sporadically defective - price unknown

With this list in the luggage, we picked up the vehicle and did not even think about the so-called luxury liner officially register and admit. A first consultation with the seller ended with a “can't be” - “never” and finally after a few more phone calls with an “ok, we'll refund you an amount”.

We wanted to stay fair and of course we also considered that the above prices are all prices that a Volkswagen dealer calls. Of course, the whole can be significantly cheaper one tries, for example, not to buy the vehicle battery at VW and the same applies to the wheel bearings and the wages we have to talk to a free workshop. By contrast, parts such as the original wiring harness for the tailgate, the parts for the air suspension or even the defective Keyless Go can only be replaced with original components and that they should not be used in masses on known platforms for a rare vehicle like the VW Phaeton also be clear. But if you rely on a car you can only bite into the sour apple and order the parts again.

Refund? Sounds fair ...

Nevertheless, we were carried away to say that we agree to a written credit of 600 € and have taken the vehicle to our workshop for repair. While the repair of the vehicle was completed in a few days, it seems to be much more difficult for the car dealer to make a simple transfer.

Last week we decided to hand the whole thing over to a law firm for criminal and civil law and see what can now be achieved legally. We will inform you about it in note form in the next few weeks and are curious to see what result our lawsuit will lead to. EDIT: Today arrived after 2 months but then the transfer and thus the chapter is also over for us!
