Despite the key in the mobile home: Comprehensive insurance remains subject to payment!

If the key to an RV is left in the unlocked vehicle due to a communication breakdown, it is not gross negligence, and the comprehensive insurance is obliged to cover the damage. This is currently indicated by a judgment by the Hamm Higher Regional Court (Az.: 6 U 107/21), which is emphasized by the ADAC. In the case in question, a mobile home had been stolen while a couple were traveling in it. The casco insurance was supposed to compensate for the damage, but refused to pay because the key was demonstrably left in the unlocked vehicle. The insurer saw this as gross negligence. The couple concerned disputed the view and filed a lawsuit.

The husband had intentionally left the key in the RV during a lunch break as his wife was still in the vehicle. He asked her to take the key with him, but she misunderstood and left the key in the vehicle when she later exited. The higher regional court ruled that there was no gross negligence in this situation: the husband had intended not to leave the key in the vehicle. A misunderstanding eventually led to the problem. According to the court, this does notinexcusable breach of duty"In the sense of gross negligence. The fact that he had not explicitly asked his wife to lock the mobile home was also proven not as grossly negligent classified: The court concluded that he could assume that the woman would lock the vehicle if she took the key with her when leaving the mobile home. It was therefore decided that the insurance company would have to pay for the damage.
