North Rhine-Westphalia, Bremen, Hamburg, Lower Saxony and Schleswig-Holstein have suggested a change to some paragraphs in the Bundesrat with a possible amendment to the Federal Non-Smoking Protection Act (BNachrSchG). This application is now being made for the second time and the intended penalties are expected to be huge. The well-founded objection is underpinned by the fact that smoking is rarely given up on a voluntary basis, despite the presence of children, young people or pregnant women, and therefore one looks forward to a legally binding requirement. Violators are to be fined from 500 to 3.000 euros can be prosecuted. And it should also be punished if the driver is driving with open windows or a partially open sunroof. An exception to this are cars with a completely open top (convertibles).

The Federal Council sees the problem of passive smoking in cars in this attempt to change the law and would like to achieve a ban on it. According to a statistical evaluation, around 166.000 children worldwide die every year as a result of passive smoking. It was also found that passive smoking in the car converts a very high concentration of harmful pollutants and this is highly harmful primarily for minors and pregnant passengers. A measurement by the German Cancer Research Center (dkfz) showed the exposure to pollutants in a smoky car that was up to five times higher than, for example, in an average smoky bar.

The Cancer Research Center estimates that around one million minors in Germany are currently exposed to tobacco smoke in cars. The draft of the law was forwarded by the Bundesrat to the Bundestag, which will now decide whether the proposal will be implemented. This is also based on some European countries, in which a smoking ban in the car is already in force and violations are punished. This was implemented in the UK in 2015 and has been in place ever since when present prohibition of smoking in cars by minors and pregnant women. The Federal Council sees the only slightly increased effort for enforcement as a further positive point, since the implementation could be carried out during a routine check during a traffic check. If you are traveling alone in the vehicle, you can of course continue to smoke.
