In the event of a red light violation, the principle is that anyone who recognizes that they can no longer cross a stop line before the traffic light shows red and still does so, acts deliberately. This principle applies in particular if a road user accelerates at a yellow traffic light in order to be able to cross it without having to wait. With this rule, the ADAC refers to the judgment of a higher court (Az .: 3 Ws (B) 131/21).
Example: Conviction of willful behavior in road traffic
A road user drove his car towards a traffic light. When it turned yellow, he accelerated further and when it was red, he was 2-3 car lengths away. He crossed the street anyway. Since the police were nearby and were able to watch the incident, the man was charged intent imposed a double fine. He did not want to recognize the judgment and lodged an objection. However, his objection was not accepted in court, he was found guilty and had to pay the fine.
